      01 Can a foreigner open a sole proprietorship in Poland?

      Only with a qualifying residence title. EU, EEA and Swiss citizens can, as can holders of permanent residence, EU long-term residence, several temporary permits including full-time studies and family reunification, protection statuses and a valid Karta Polaka — and Ukrainian citizens staying legally under the special act. A temporary residence permit issued for work does not qualify, which surprises most people, because it is the permit most people have.

      02 Can I register a Polish company without coming to Poland?

      Yes, on either of two routes. With a qualified electronic signature recognised across the EU, or a Polish trusted profile, you can sign the S24 template articles from anywhere and the company is registered online. Without one, a notarial deed signed by a proxy works: you grant a power of attorney before a notary where you live, have it apostilled and sworn-translated, and your attorney signs in Poland. Only the bank account tends to require you in person, and even that is loosening.

      03 Does opening a company give me the right to live in Poland?

      No. Registering a company and obtaining a residence permit are separate processes with separate authorities, and owning shares in a Polish company is not by itself a basis for residence. There is a temporary residence permit tied to business activity, but it comes with its own income and employment thresholds that a newly formed company will not meet in its first year. Treat the company as a business decision and residence as a second, longer project.
